ColleXable Terms and Conditions

ColleXable is a platform built for collectors who care about authenticity, provenance and limited availability. These Terms explain how our platform works, what you can expect from us, and what we expect from you. 
 
1. Definitions 

In these Terms and Conditions, the following words have the meanings set out below: 

  • ColleXable”, “we”, “us”, “our”, “my” means ColleXable Ltd, acting as a data controller and operating a global online store for collectables and the Blind Dutch Auction (BDA) platform. 
     

  • “Client”, “you”, “your” means any natural or legal person using ColleXable’s services. 
     

  • “Website” means www.collexable.com and any related subdomains. 
     

  • MyPage” means your user panel for managing your account, orders, payments, and preferences. 
     

  • “Products” means collectables offered for sale on the Website. 
     

  • BDA” means Blind Dutch Auction: an auction format with limited bid information. The ColleXable BDA is optional, transparent in its rules, and binding once you choose to participate. 
     

  • “Order” means a binding order placed by the Client. 
     

  • “Agreement” means the agreement between ColleXable and the Client, which is formed when we confirm your Order. 
     

  • “Business Hours” means the customer service hours shown on the Website. 
     

  • “Business Days” means Monday to Friday, excluding public holidays. 

 

2. Scope of the Agreement 

These Terms and Conditions govern your use of the ColleXable platform, including: 

  • purchasing Products, 

  • access to MyPage, 

  • customer support by phone, email and chat, 

  • participation in BDA auctions, 

  • payments, delivery and returns, and 

  • use of personal information. 

By using the Website, you confirm that you have read and accept these Terms. 

 
3. Customer Rights 

To make a purchase, you must be at least 18 years old. 

If you place an order from outside the UK, you are responsible for making sure that purchasing and importing collectible products is legal in your country or region. 
 

4. Client Obligations 

You agree to: 

  • provide accurate and up-to-date information, 

  • keep your account secure and not share access with third parties, 

  • follow all BDA rules and instructions, 

  • not attempt fraud, chargebacks, auction manipulation, or automated/bot activity, and 

  • use chats and contact features responsibly and lawfully. 

We may suspend or block accounts where we reasonably suspect abuse or breaches of these Terms, to protect collectors and the integrity of the platform. 
 
5. Obligations of the Seller 

ColleXable is committed to: 

  • presenting Products reliably and accurately, 

  • processing and shipping orders within the stated timeframes (where provided), 

  • providing customer service during Business Hours, 

  • processing payments securely, and 

  • protecting personal data in accordance with applicable data protection laws. 

6. Orders and Contracts 

Placing an Order is your offer to purchase. 

A contract is formed only when we confirm your Order by email or SMS. 

We may reject or cancel an Order, including (but not limited to) where: 

  • a Product is unavailable, 

  • we suspect misuse or abuse of the platform, or 

  • payment fails or cannot be authorised. 

 

7. Prices and Taxes 

Prices are displayed in the currency appropriate for your region. 

Depending on where you live, the price may be affected by: 

  • import taxes or duties, 

  • customs charges, and/or 

  • local sales taxes. 

Where such charges apply, they are your responsibility unless we explicitly state otherwise at checkout. 

8. Payment Terms 

Accepted payment methods are shown at checkout (“Finalisation” page). Payment must be authorised at the time of purchase. 

Fraudulent payment activity (including chargeback abuse) may result in your account being blocked and the matter being reported to relevant banking/payment institutions. 

Telephone payments must meet PCI-DSS requirements and are processed using certified systems. Our agents do not store full payment card details. 

9. Delivery 

We deliver globally, subject to legal restrictions. 

Delivery times depend on the destination country and shipping method. 

You are responsible for providing correct delivery details. If you provide incorrect details (including address errors), you may be responsible for additional shipping costs or failed delivery. 

Collectables require careful handling. Any delivery damage must be reported within 48 hours of delivery with supporting evidence. 

We do not ship to countries subject to international sanctions, including Sudan, North Korea, Iran, Syria, and Cuba. This list may change depending on sanctions and legal requirements. 

 

10. Refunds and Cancellations 

Because our products are genuine collectables with real market value, some items can’t be returned once opened. This protects both collectors and the integrity of the items. Return rules are explained in our Return Policy. 

Refunds may be available in cases such as: 

  • order errors, 

  • transport damage, and/or 

  • where you validly withdraw from the contract within 14 days from receipt (where applicable by law), provided the product is undamaged and in unopened packaging. 

 

Products purchased via BDA may be non-refundable where the auction rules provide this. 

11. My Account on the Website (MyPage) 

MyPage allows you to: 

  • update your account details, 

  • monitor orders and payments, 

  • request refunds, 

  • receive product recommendations (cross-selling), and 

  • view your BDA history (where available). 

You are responsible for maintaining the confidentiality of your login details. 

 
12. BDA (Blind Dutch Auction) Rules 

Participation in BDA is voluntary. 

Key characteristics of BDA include: 

  • the price decreases at set intervals, 

  • other participants’ offers are not visible, and 

  • the first person to accept the displayed price wins. 

Once a BDA price is accepted, the purchase is binding and cannot be withdrawn. 

Auction manipulation, use of bots/automation, or creation of multiple fictitious accounts may result in results being blocked and/or invalidated and accounts being suspended. 

13. Contact Rules (Phone, Email, Chat) 

Telephone 

  • Calls are handled during Business Hours. 

  • Outside Business Hours, voicemail may be available. 

Email 

  • We respond during Business Hours. 

  • You may receive an automatic confirmation acknowledging receipt. 

Chat 

  • Available 24/7 as an AI-powered FAQ tool designed to answer common questions. 

  • Human consultants may supervise responses and may be available during consultation hours. 

  • If the chat does not resolve your issue, you will be offered a route to escalate/appeal (where available). 

 

14. Marketing Consents 

You may choose to consent to marketing communications via email, phone, SMS or WhatsApp. 

You can change or withdraw your consents at any time, including via: 

  • phone, 

  • email, 

  • written request, and/or 

  • through MyPage. 

Withdrawing consent does not affect the lawfulness of marketing communications sent before the withdrawal took effect. 

 
15. Cookies and Electronic Communications 

We use technical, analytical and marketing cookies. Details are set out in our Cookie Policy. 

16. Liability 

To the maximum extent permitted by law, ColleXable is not liable for: 

  • indirect damages or consequential losses, 

  • lost profits, 

  • delays in customs clearance, 

  • postal/courier operator errors, or 

  • losses arising from the Client improperly disclosing their data or account access. 

Our total liability is limited to the value of the relevant Order. 
 

17. Fraud Prevention 

ColleXable may take steps to prevent fraud, including: 

  • holding an Order, 

  • requesting identity verification, and/or 

  • blocking an account where we reasonably suspect abuse. 

 

Suspected fraud may be reported to law enforcement or relevant authorities. 

18. Account Termination 

We may close or suspend a Client account in cases including: 

  • breach of these Terms, 

  • scam or fraudulent behaviour, 

  • BDA abuse, and/or 

  • failure to comply with payment policies. 

19. Governing Law 

These Terms are governed by UK law. 

Disputes are handled by the courts of competent jurisdiction in the United Kingdom, unless your country’s consumer laws require a different approach.
